"Celebrate Spritzer Season" Contest

OFFICIAL RULES

NO PURCHASE OR PAYMENT NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

ELIGIBILITY: To participate in the Barefoot Refresh “Celebrate Spritzer Season” Contest (“Contest”), you must be a legal resident of one of the fifty (50) United States or the District of Columbia (excluding UT) and be at least 21 years of age at time of entry. VOID IN UTAH, PUERTO RICO, U.S. VIRGIN ISLANDS, AND OTHER U.S. TERRITORIES AND POSSESSIONS, AND WHEREVER PROHIBITED OR RESTRICTED BY LAW. Employees, officers, and directors (including immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of E. & J. Gallo Winery (“Sponsor”), The Sacramento River Cats, the NAPBL Entities (defined below), and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, advertising and promotion agencies, any alcoholic beverage distributors, authorized licensees, retail licensees, wholesale licensees, and any and all other companies associated with the Contest are not eligible to participate or win the Prize (defined below) .The “NAPBL Entities” shall mean The National Association of Professional Baseball Leagues, Inc. ("NAPBL"), each NAPBL Club, each NAPBL League, Professional Baseball Promotion Corporation, Professional Baseball Umpire Corp., Baseball Internet Rights Company LLC, BIRCO Holding Company LLC, MiLB Enterprises LLC, MiLB Enterprise Holdings LLC, Minor League Baseball Charities, and each of their subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the NAPBL and the NAPBL clubs and leagues, and all officers, directors, employees, agents, partners, and members of those entities.

HOW TO ENTER: The Contest entry period is as follows:

Entry Period #1 and Entry Period #2 are collectively referred to as the Entry Periods.

To enter the Contest, (i) go to Raley Field located at 400 Ballpark Drive W, Sacramento, California (“Raley Field”) during the Entry Periods; (ii) and appear in a short video and say the phrase, “Celebrate Spritzer Season” in front of a Barefoot backdrop (the “Entry” or collectively, the “Entries”). Your Entry must be in English. Limit: One (1) Entry per person, per household. Entries will not be acknowledged or returned.

CONTEST ENTRY CRITERIA: In addition to the above requirements, each Entry must meet the following content restrictions:

· The Entry must be the your original work, created solely by you and must not contain material that violates or infringes another's rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright or trademark infringement;

· The Entry must not contain any reference to gambling on sports, athletes using illegal drugs, nudity or other activities that would tend to bring disrepute to the game of baseball, Minor League Baseball, its member leagues and clubs, or the Logos;

· The Entry must not contain sexually explicit content, violence or objectionable material that Sponsor determines in its sole discretion is inappropriate, indecent, obscene, abusive, hateful, tortuous, defamatory, slanderous, libelous or offensive;

· The Entry must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

· The Entry must not contain material that is unlawful, in violation of or contrary to any applicable laws, rules or regulations. The Entry must not contain any personally identifiable information of any person other than you. Should you include personally identifiable information about yourself in your Entry, you acknowledge and agree that such information will be disclosed publicly and you are solely responsible for any consequences thereof.

· The Entry must not contain any commercial content or logos.

· The Entry may not have been previously published and must not have won previous awards.

For all Entries:

By submitting your Entry, you agree that your Entry conforms to these Official Rules and that Sponsor, in its sole discretion, may disqualify your Entry for any reason at any time, including if it determines, in its sole discretion, that your Entry fails to conform to these Official Rules in any way or otherwise contains unacceptable content as determined by Sponsor, in its sole discretion.

By submitting an Entry, you hereby grant permission for the Entry to be posted on the Website and any other web sites. You agree that Released Parties (as defined below) are not responsible for any unauthorized use of Entries by third parties. Released Parties do not guarantee the posting of any Entry. You agree that you will not use the Entry for any other purpose, including, without limitation, posting the Entry to any online social networks, without the express consent of Sponsor in each instance.

PRIZES: One thousand (1,000) Grand Prizes: one (1) pair of tickets to the River Cats vs. Memphis Redbirds game on May 21, 2015 at Raley Field for each Grand Prize winner and a guest over age 21. The Approximate Retail Value (the “ARV”) of each Grand Prize is $28. The total ARV is $5,600. Limit one (1) prize per household, per person. All prize details are at Sponsor’s sole discretion. Seat locations for tickets are at Sponsor’s sole discretion and are subject to the rain check policies and terms and conditions as printed on the tickets.

CONTEST JUDGING AND NOTIFICATION: Entries received during the Entry Periods will be judged by a panel of judges appointed by the Sponsor according to the following procedures and criteria:

Contest judging will occurring according to the following schedule:

Each Entry will receive a score between zero (0) and thirty (30) points by the judges. The Entries with a score of fifteen (15) points or higher will be deemed a potential Grand Prize winner. In the event of a tie, the tied Entries will be judged by an additional judge appointed by Sponsor who will serve as a tie-breaker, using the same criteria as outlined above, to determine the potential winner. One Thousand (1,000) Grand Prize winners will be determined on May 20, 2015 and May 21, 2015. Potential winners will be notified in-person during Judging Period #1, Judging Period #2 and Judging Period #3. Any winner notification or prize returned to Sponsor as undeliverable, or the determination that a potential winner (as applicable) is not eligible to receive a prize, may result in disqualification and the next highest scoring Entrant may be notified. The inability of Sponsor to contact a potential winner within a reasonable time period may result in disqualification and, at Sponsor’s sole discretion, the prize may be awarded to the next highest score. Prizes will be awarded to the winners during the Entry Periods. Sponsor reserves the right not to award all prizes if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries. Prize awards are subject to verification of eligibility and compliance with these Official Rules. Judges’ and Sponsor’s decisions are final and binding on all matters relating to this Contest.

TERMS AND CONDITIONS: No substitution, assignment, or transfer of any prize is permitted except that Sponsor reserves the right to substitute a prize or prize component of equal or greater value in the event that an offered prize is unavailable. If not all prizes are awarded in one Judging Period, the prizes may, in Sponsor’s discretion, roll over to the next Judging Period. This Contest is subject to all applicable federal, state, and local laws. All federal, state, and/or other tax liabilities are the sole responsibility of the prize winner. By participating, you agree to be bound by these Official Rules and the decisions of the Sponsor, and the Independent Contest Administrator, and you waive any right to claim ambiguity in regard to the Contest mechanics, and/or the interpretation of these Official Rules. By participating, you agree to release, discharge, indemnify and hold harmless the Sponsor, Contest Administrator, and any vendors/prize providers that may be associated with this Contest, and the respective officers and employees of these entities (“Released Parties”), from and against any claims, damages or liability due to any injuries, damages or losses to any person or property of any kind resulting in whole or in any part, directly or indirectly, from participation in this Contest or the receipt and/or use of any prizes won. By participating, you further agree to the use of your name, voice, performance, photograph/video, image and/or likeness for advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited by law) or additional consents you agree from you or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so. Entries will not be acknowledged or returned.

LICENSE TO ENTRY. By submitting an Entry, you irrevocably grant Sponsor and its designated agents the royalty-free right throughout the world in perpetuity to use, re-use, copy, publish, copyright, republish in whole or in part, edit, add to, modify, and rearrange the Entry in whatever media now known or hereafter developed, for use in the advertising and promotion of Sponsor and Sponsor’s products without further permission, approval, consideration or payment to you, except where prohibited by law. You agree to sign any document requested by Sponsor to further confirm this license.

LIMITATIONS OF LIABILITY: Sponsor is not responsible for lost, late, incomplete, misaddressed, or otherwise misdirected Entries that are processed late or incorrectly or are lost due to computer or electronic malfunction or other error. Released Parties are not responsible for any incorrect or inaccurate information, including, without limitation, that caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of submissions in the Contest.

PRIZES ARE AWARDED AS IS AND WITHOUT WARRANTY, GUARANTEE OR REPRESENTATION OF ANY KIND, EXPRESSED OR IMPLIED (INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE).

GOVERNING LAW & JURISDICTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to the conflict of laws rules thereof. Entrants consent to jurisdiction and venue in, and agree that any claims or disputes shall be resolved exclusively in, the federal and state courts located in Stanislaus County, California.

WINNERS LIST: For confirmation of the winners send a self-addressed, stamped envelope to the Administrator at the address below (include the name of this Contest), by June 24, 2015.
